In addition, if the Participant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the Participant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (9) with the exception of subpart (6) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (6) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither Sponsor nor Participant shall be entitled to arbitrate their dispute. COMO SE INDICA EN DETALLE MÁS ADELANTE, USTED ACEPTA QUE TODAS LAS DISPUTAS RELACIONADAS CON EL CONCURSO DE LOS MEDIOS SOCIALES (DEFINIDAS A CONTINUACIÓN) SE RESOLVERÁN MEDIANTE ARBITRAJE VINCULANTE (consulte la Regla 9E: Arbitraje).

Si elige participar a través de un dispositivo móvil: Se podrán aplicar los aranceles por mensajes y datos de acuerdo con el plan de aranceles de su empresa prestadora de servicios móviles/inalámbricos. Tales aranceles se podrán aplicar incluso aunque el uso de su dispositivo móvil no origine su participación en el Concurso. El acceso a Internet puede no estar disponible para todas las prestadoras de servicios inalámbricos o en todas las áreas.

 

1. ASPECTOS GENERALES DE LA PROMOCIÓN: El Concurso para Redes Sociales 2013 de U.S. Soccer de McDonald’s (el “Concurso para redes sociales”) consiste en dos (2) promociones (una asociada con el identificador @McDonalds Twitter y la otra asociada con el identificador @MeEncanta Twitter), cada uno de los cuales comienza a las 12:00:00 a. m., o después de dicho horario, hora del Este (“ET”), el 15 de junio de 2013, o alrededor de esa fecha, y finaliza a las 11:59:59 p. m., ET, del 25 de junio de 2013 (el “Período de Participación”) para tener la oportunidad de ganar los premios (“Premios”) que aparecen en la Regla 5 a continuación. Para participar, siga la página oficial de Twitter de McDonald’s USA, en https://twitter.com/mcdonalds (Página de Twitter de “McDonald’s”) y, durante el Período de Participación, tuitee, a través de una contestación @reply a @McDonalds o a @MeEncanta, la respuesta a la pregunta del día con la etiqueta #McDSoccer (cada una de las cuales, una “Participación”), todo lo que se describe con más detalle en la Regla 3 a continuación. Usted puede encontrar la pregunta actual del día en la Página de Twitter de McDonald’s. Una persona que participa en el Concurso para redes sociales es un participante (“Participante”). Límite de una participación por cada identificador en (@McDonalds o @MeEncanta) por día. Cada Participante acepta y se compromete incondicionalmente a cumplir y a respetar estas Reglas Oficiales y las decisiones de McDonald’s USA, LLC (el “Patrocinador”), las cuales serán definitivas y vinculantes en todo aspecto. (El Concurso para Redes Sociales es completamente independiente del Concurso McDonald’s® 2014 FIFA World Cup Brazil™ [Copa del Mundo FIFA Brasil 2014 de McDonald’s®], que es una promoción por separado que ofrece diferentes premios con sus propias probabilidades de ganar).

 

2. ELEGIBILIDAD: El Concurso para Redes Sociales está abierto únicamente a los residentes de los cincuenta (50) estados de los Estados Unidos y del Distrito de Columbia (DC) (el “Territorio”) que tengan veintiún (21) años de edad o más al momento de la Participación. Un Participante debe tener una Cuenta de Twitter, acceso a Internet y una dirección de correo electrónico válida al momento de la Participación. Las personas que figuran en cualquiera de las siguientes categorías NO califican para participar: toda persona que al 1.° de enero de 2013, o después de esa fecha, (a) era o es dueño de una franquicia de restaurantes McDonald's, o un director, directivo, empleado, agente o contratista independiente de un restaurante de la franquicia de McDonald's; (b) era o es director, directivo, empleado, agente o contratista independiente del Patrocinador, su casa matriz, subsidiarias, empresas afiliadas o agencias prestadoras de servicios; (c) los empleados, directores o directivos de cualquier entidad involucrada en el desarrollo, la producción o distribución de los materiales del Concurso para redes sociales o de cualquier entidad que contrate el Patrocinador para administrar el Concurso para Redes Sociales; (d) los directores, socios, gerentes, funcionarios y empleados de U.S. Soccer, The Coca-Cola Company, Electronic Arts Inc. o FIFA; y (e) las personas que sean familiares cercanos (que se definen como el cónyuge, una persona a cargo para la IRS, o cónyuge, una persona a cargo para la IRS, o madre, padre, hermana, hermano, hija, hijo, suegra, suegro, cuñada, cuñado, nuera, yerno, madrastra, padrastro, hermanastra, hermanastro, hijastra o hijastro,  ya sean familiares biológicos, por afinidad, adoptivos o de crianza) de cualquier persona que figure en las categorías anteriores, o que viva en su misma casa.

 

3. CÓMO PARTICIPAR:

 

A. Envío de Participaciones: Cada Participante debe tener una cuenta de Twitter válida y ser seguidor de @McDonalds para participar en el Concurso para Redes Sociales. Se puede abrir una cuenta de Twitter sin costo en www.twitter.com. Si usted ya tiene una cuenta de Twitter, ingrese usando su nombre de Twitter y contraseña, luego hágase seguidor de la página oficial de McDonald’s USA en Twitter en https://twitter.com/mcdonalds haciendo clic en “seguir” (si no es ya seguidor de @McDonalds.) Usted también puede enviar participaciones si es seguidor de @MeEncanta.com. Todas las Participaciones deben cumplir con estas Reglas Oficiales, las Reglas de Twitter Rules y las Condiciones de Servicio de Twitter; se aplican todos los términos y condiciones de Twitter. Para participar, tuitee, usando la función @Reply de Twitter, la respuesta a la pregunta del día para este Concurso para Redes Sociales que aparece en la Página de Twitter de McDonald’s, junto con la etiqueta #McDSoccer a @McDonalds o a @MeEncanta. NO INCLUYA OTRO MENSAJE EN SU TUIT DE PARTICIPACIÓN. Al tuitear la etiqueta, está confirmando que tiene 21 años de edad o más, que reside en uno de los cincuenta (50) estados de los Estados Unidos o en el Distrito de Columbia, que cumple con los demás requisitos para participar de este Concurso para Redes Sociales y que ha leído y acepta las Reglas Oficiales que se encuentran en: http://mcdonalds.posthaven.com/reglas-oficiales-del-concurso-para-medios-sociales-2013-de-us-soccer-mcdonalds-r O: http://mcd.to/13EBzIq. Otros requisitos para las Participaciones: (i) las Participaciones deben ser públicas y NO un mensaje privado; (ii) queda prohibido retuitear; (iii) solo se puede usar una (1) cuenta de Twitter para participar y el uso de varias cuentas originará la descalificación; las Participaciones deben ser en inglés. Hay un límite de una (1) Participación (tuit) por identificador por Participante por día. En caso de una disputa, la Participación se considerará hecha por el titular autorizado de la cuenta de Twitter usada para enviar la Participación (siempre que esa persona cumpla también con los requisitos de acuerdo con estas Reglas Oficiales); el Patrocinador realizará dicha determinación a su exclusivo criterio.

 

El Patrocinador, a su exclusivo criterio, puede aceptar o descalificar una Participación que contenga un término único requerido técnicamente incorrecto o contenido por sobre el contenido requerido. Las Participaciones que no son realmente visibles y recibidas por el Patrocinador no ingresarán en el Concurso. A los fines de este Concurso, una Participación se “recibe” cuando el sitio web de Twitter registra su Participación y es visible para el Patrocinador y aparece ya sea en la bandeja de entrada de @Reply de @McDonalds o @MeEncanta. Las Participaciones incorrectas y/o incompletas, las Participaciones recibidas fuera del Período de Participación y/o las Participaciones que contengan lenguaje obsceno, ofensivo o cualquier lenguaje que comunique mensajes que no se condigan con las imágenes positivas a las que el Patrocinador desea estar asociado (todo según lo determine el Patrocinador a su exclusivo criterio) serán nulas.

 

EN TODO MOMENTO, USTED PUEDE DEJAR DE SEGUIR AL PATROCINADOR, CANCELAR O DE OTRA FORMA DISCONTINUAR SU CUENTA DE TWITTER, PERO ESTO PUEDE AFECTAR SU ELEGIBILIDAD PARA COMPETIR O PARA GANAR UN PREMIO.

 

B. Restricciones a la Participación: Nota: El Patrocinador no puede recibir participaciones de usuarios de Twitter con actualizaciones “protegidas” (es decir, el usuario configuró su cuenta de forma que solo la gente que el usuario aprobó pueda ver sus actualizaciones) debido a la forma en que Twitter opera su servicio. Una vez recibidas, las Participaciones se convierten en propiedad del Patrocinador y no se acusará recibo ni serán devueltas. No se aceptarán, reconocerán o responderán preguntas relacionadas con el Concurso para Redes Sociales. No se aceptará ninguna otra forma de Participación que no sea la establecida en estas Reglas Oficiales. Las Participaciones que no cumplen con los requisitos de estas Reglas Oficiales serán descalificadas. Hay un límite de un (1) Premio por familia/dirección/vivienda familiar durante el Período de Participación.

 

4. DETERMINACIÓN/NOTIFICACIÓN DEL GANADOR DEL PREMIO: Se realizarán sorteos al azar (un conjunto de sorteos para las Participaciones de @McDonalds que cumplen con los requisitos y un conjunto de sorteos para las Participaciones de @MeEncanta que cumplen con los requisitos) el 26 de junio de 2013, o alrededor de esta fecha, para elegir un (1) ganador potencial del Premio mayor, tres (3) ganadores de una Arch Card por 50 USD y tres (3) ganadores del Premio Coca-Cola por cada identificador, por medio de una organización juzgadora independiente elegida por el Patrocinador, cuyas decisiones son definitivas en todas las cuestiones. Tome en cuenta que las Participaciones para el sorteo de @McDonalds no entrarán en el sorteo de @MeEncanta o viceversa. Estos sorteos serán realizados por una organización juzgadora independiente. Las posibilidades de ganar un Premio dependerán de la cantidad total de Participaciones elegibles que se hayan recibido para el Período de Participación para ese sorteo.

 

Cada ganador potencial de un Premio será notificado el mismo día o el día hábil siguiente del sorteo al azar a través de un mensaje privado (directo) a su cuenta de Twitter. Los Participantes deben “seguir” la Página Oficial de McDonald’s en Twitter (@McDonalds o @MeEncanta) para recibir el mensaje privado (directo) enviado en nombre del Patrocinador si su Participación resulta elegida en el sorteo al azar. Para seguir cumpliendo con los requisitos para ganar el (los) Premio(s), el receptor del mensaje privado (directo) debe seguir las instrucciones y responder al mensaje privado (directo) con su información de contacto completa dentro de las veinticuatro (24) horas de la transmisión; no responder a tiempo puede originar la descalificación y la elección de un ganador alternativo (para el Premio mayor, si el tiempo lo permite).

 

5. PREMIOS/VALOR DE VENTA AL PÚBLICO APROXIMADO:

Dos (2) Premios mayores (uno [1] para el ganador del sorteo por el premio mayor de @McDonalds y uno [1] para el ganador del sorteo por el premio mayor de @MeEncanta): Un viaje de tres (3) días y dos (2) noches para el ganador y un (1) acompañante (dicha persona debe tener al menos veintiún [21] años de edad a partir del primer día programado del viaje) en las fechas seleccionadas por el Patrocinador el o alrededor del 9 de septiembre de 2013 hasta el 11 de septiembre de 2013, a Columbus (Ohio, Estados Unidos), para asistir al partido de clasificación de la Copa Mundial de la FIFA 2014™ entre los Estados Unidos y México, actualmente programado para el 10 de septiembre de 2013. Cada Premio mayor consiste únicamente en lo siguiente: pasaje aéreo de ida y vuelta en clase económica para el ganador y un (1) acompañante desde un aeropuerto principal cercano a la residencia del ganador del Premio mayor hasta el aeropuerto de Columbus, Ohio, (aeropuertos seleccionados a criterio exclusivo del Patrocinador); traslados en Columbus, dos (2) noches de alojamiento (una habitación doble estándar) en un hotel seleccionado a exclusivo criterio del Patrocinador; una (1) tarjeta Arch Card® de McDonald’s por 50 USD y un regalo de bienvenida; dos (2) entradas para el partido de clasificación de la Copa Mundial de la FIFA 2014™ entre los Estados Unidos y México (la ubicación de las entradas será determinada por el Patrocinador); transporte desde el hotel hacia el estadio; y 250 USD para gastos incidentales en forma de tarjeta de regalo seleccionada por el Patrocinador (la tarjeta de regalo está sujeta a sus términos y condiciones). Valor de venta al público aproximado (VVA) de cada Premio mayor: 3.400 USD.

Seis (6) Premios consistentes en una Arch Card® (seis [6] ganadores: tres [3] para el sorteo de @McDonalds y tres [3] para el sorteo de @MeEncanta): Una tarjeta Arch Card® de McDonald’s por 50 USD.

Seis (6) Premios de Coca-Cola (seis [6] ganadores: tres [3] para el sorteo de @McDonalds y tres [3] para el sorteo de @MeEncanta): Un paquete de premio que incluye una remera de la marca Coca-Cola, una pelota de fútbol, una toalla, un bolso y un sombrero, VVA: 50 USD. El valor total de cada Premio es 50 USD. El VVA de todos los premios: 3.700 USD para @McDonalds y 3.700 USD para @MeEncanta.

 

6. CONDICIONES/REQUISITOS DE LOS PREMIOS:

A. Premio mayor: Al recibir la información de contacto del potencial ganador (de acuerdo a la Regla 4 anterior), los ganadores potenciales del Premio mayor serán contactados dentro de dos (2) días hábiles y recibirán los Documentos para Reclamar el Premio que incluyen una Declaración Jurada de Elegibilidad, la Exención de Responsabilidad/Exención de Publicidad, el formulario de autorización para verificar los antecedentes, una identificación con foto, el formulario de aceptación del Premio, la exención del acompañante, documentación impositiva (en conjunto, los “Documentos para Reclamar el Premio”). El Centro de Canje de McDonald’s debe recibir los Documentos para Reclamar el Premio dentro de los tres (3) días de recibida la notificación, pero a más tardar el 29 de junio de 2013. Recibirlos después de esa fecha ocasionará que el ganador potencial sea descalificado, y el Premio se otorgará a un ganador alternativo (si el tiempo lo permite). Se exigirá al ganador potencial del Premio mayor que se someta a una verificación confidencial de antecedentes para confirmar su elegibilidad y que cumple con los requisitos de seguridad establecidos por el Patrocinador o U.S. Soccer y ayudar a garantizar que el uso de dicha persona en la publicidad o promoción del Concurso para Redes Sociales no representará un descrédito, menosprecio, escándalo ni ridículo para el Patrocinador o U.S. Soccer , ni afectará desfavorablemente al Concurso para Redes Sociales, al Patrocinador o U.S. Soccer, según lo determine el Patrocinador a su exclusivo criterio. Se podrá exigir al ganador del Premio mayor y a su acompañante que cumplan con ciertos criterios de seguridad establecidos por el Patrocinador o U.S. Soccer para recibir el Premio mayor o concurrir a los eventos del Premio mayor. Si el ganador del Premio mayor o su acompañante no cumplen con cualquiera de tales criterios, el Patrocinador puede elegir (a su exclusivo criterio) otorgar al ganador del Premio mayor un cheque de igual monto al VVA del Premio mayor ganado. El Patrocinador se reserva el derecho de descalificar, a su exclusivo criterio, a un ganador del Premio mayor si el Patrocinador determina que la ley no permite que tal persona reciba alguna parte del Premio mayor. El Patrocinador se reserva el derecho de abstenerse a realizar cualquier tipo de aviso o publicidad relacionada con el ganador del Premio mayor por cualquier razón.

Cualquier y todo costo, arancel (incluidos, a título enunciativo, los aranceles por equipaje y transporte entre la casa del ganador del Premio mayor y el aeropuerto de salida) y los gastos que no se encuentran expresamente establecidos en la descripción del Premio mayor son la exclusiva responsabilidad de cada ganador del Premio mayor. Cualquier diferencia entre el valor de venta al público aproximado y el valor de venta real del Premio mayor no será reconocida, y no se devolverá ninguna diferencia. No se proporciona ningún tipo de seguro como parte del Premio mayor, y obtener tal seguro, por ejemplo y a título enunciativo, seguro de viaje, de salud, de accidentes o médico, y un seguro por pérdidas o daños a la propiedad, es la exclusiva responsabilidad de cada ganador del Premio mayor y/o del acompañante del ganador del Premio mayor. El Patrocinador determinará el viaje y otros arreglos. El viaje aéreo será de ida y vuelta (el aeropuerto de origen y de destino será el mismo) en clase turista desde un aeropuerto a elección del Patrocinador. Antes del viaje se deben hacer las reservas y emitir los pasajes. No se aceptan cambios en las reservas. El Ganador del Premio y su Acompañante deberán viajar juntos con el mismo itinerario y son enteramente responsables de contar con los documentos requeridos para el viaje (incluidos los documentos de identificación válidos con fotos emitidos por el gobierno y/o cualquier pasaporte o visa requeridos) antes de la partida, así como de cumplir con todos los requisitos de viaje y de seguridad. El Patrocinador se reserva el derecho, a su exclusivo criterio, de designar todos los detalles de vuelos/viajes, ruta o rutas (según sea el caso). Los horarios de la aerolínea están sujetos a cambio sin previo aviso. El Patrocinador y U.S. Soccer no se responsabilizan por ningún contratiempo o gasto ocasionado como consecuencia de la cancelación o demora del vuelo o demora en el transporte terrestre. Se podrá exigir al ganador del Gran Premio que proporcione una tarjeta de crédito actual y válida al momento de registrarse en el hotel para cubrir gastos accesorios, y cualquier y todo costo, tarifa y gasto que no se encuentre expresamente establecido en la descripción del Premio mayor. Se podrán aplicar otras restricciones y fechas bloqueadas. Una vez que se determine el acompañante, no se lo podrá cambiar sin el consentimiento expreso del Patrocinador, que podrá retenerse por cualquier motivo. El ganador del Premio mayor (y su acompañante) aceptan mantener su conducta de acuerdo con todas las leyes aplicables y prácticas sociales comúnmente aceptadas vinculadas con su participación en cualquier actividad relacionada con el Premio mayor. El ganador del Premio mayor entiende y acuerda que el Patrocinador y U.S. Soccer tienen el derecho, a su exclusivo criterio, a descalificar y retirar a un Ganador del Premio mayor o acompañante de cualquier actividad en cualquier momento si la conducta del ganador del Premio mayor o del acompañante es poco colaborativa, perjudicial o puede ser lesiva o causar daños a una persona, propiedad o la reputación del Patrocinador o U.S. Soccer, o viola de otra forma las políticas del Patrocinador o de U.S. Soccer. El ganador del Premio mayor es el único responsable del comportamiento de su acompañante.

 

B. Premios de Arch Card y Premios de Coca-Cola. Todos los demás ganadores de premios serán notificados a través de un mensaje privado (directo) en Twitter y deben responder a tiempo con su información de contacto, de acuerdo a la Regla 4 anterior. Si el ganador del Premio no lo hace, el Premio se perderá y se otorgará a un ganador alternativo del Premio que cumpla con los requisitos de estas Reglas Oficiales y que sea elegido entre todas las demás participaciones recibidas que cumplan con los requisitos. Después que un ganador del Premio haya entregado al Patrocinador o a su agencia su información de contacto, ese ganador del Premio recibirá su premio en aproximadamente cuatro (4) semanas. El Patrocinador no estará obligado a buscar más de tres (3) ganadores alternativos por ningún motivo para los Premios de Arch Card y los Premios de Coca-Cola, en cuyo caso algunos premios no serán entregados.

 

Las siguientes disposiciones se aplican a todos los Premios en este Concurso para Redes Sociales:

Todos los detalles de los Premios que no se especifiquen en estas Reglas Oficiales serán determinados por el Patrocinador, a su exclusivo criterio. Todos los impuestos (federales, estatales y locales) y otros gastos que no se especifiquen en estas Reglas Oficiales como parte del Premio son responsabilidad de cada ganador. El Patrocinador no reemplazará ningún pasaje, voucher, certificado, elemento del Premio o Premio perdido, robado o mutilado, así como tampoco ningún premio que no se puede entregar o no llegue al ganador debido a una dirección u otra información de contacto que sea incorrecta o haya sido modificada. Si el ganador no acepta o no utiliza el Premio completo, perderá la parte no aceptada o no utilizada del Premio, y el Patrocinador no asumirá ninguna otra obligación con respecto a dicho Premio o a una parte de este. No se harán transferencias, sustitución de Premios o canjes por dinero en efectivo, excepto a criterio exclusivo del Patrocinador. El Patrocinador se reserva el derecho a sustituir el Premio establecido o una parte de él por otro Premio o por una parte de otro Premio de igual o mayor valor por cualquier motivo, incluida, a título enunciativo, la falta de disponibilidad del Premio. No se adjudicarán más Premios que el número indicado. Queda estrictamente prohibido que el ganador venda, subaste, comercialice o de otra forma transfiera cualquier parte del Premio. Los premios se enviarán únicamente a la dirección postal verificada de cada ganador en uno (1) de los cincuenta (50) estados de los Estados Unidos o el Distrito de Columbia, excepto a exclusivo criterio del Patrocinador.

 

 7. CONDICIONES GENERALES/EXENCIÓN DE RESPONSABILIDAD: La participación en el Concurso para Redes Sociales no constituye la participación en ninguna otra promoción, concurso o sorteo. Como condición para inscribirse en el Concurso para Redes Sociales, cada participante presta el consentimiento al Patrocinador para obtener y entregar su nombre, dirección y demás información a terceros con el fin de administrar este Concurso para Redes Sociales y cumplir con las leyes, reglamentaciones y reglas aplicables. Los Participantes acuerdan que: (a) el Patrocinador, U.S. Soccer y cada una de sus respectivas subsidiarias, filiales, propietarios, accionistas, funcionarios, directores, agentes, representantes y empleados, y cada una de sus respectivas empresas matrices, subsidiarias y empresas afiliadas, franquiciados y cada uno de sus respectivos funcionarios, directores, agentes, representantes y empleados (individualmente y en conjunto, las “Entidades del Concurso”) son y serán exonerados e indemnizados y no tendrán responsabilidad alguna, y los Participantes los mantendrán indemnes de y contra toda responsabilidad por cualquier lesión, pérdida o daño de cualquier clase (ya sea debido a negligencia o a otra causa) a persona(s), lo cual incluye la muerte, o a la propiedad, que surja, en todo o en parte, directa o indirectamente, de la aceptación, posesión, uso indebido o uso del Premio o de la participación en este Concurso para Redes Sociales o cualquier Concurso relacionado o actividades relacionadas con el viaje; y (b) que las Entidades del Concurso no han realizado ni son de ningún modo responsables por ninguna garantía o declaración expresa o implícita, de hecho o legal, con respecto a cualquier Premio, y LAS ENTIDADES DEL CONCURSO POR EL PRESENTE SE EXIMEN DE CUALQUIER Y TODA TAL GARANTÍA, INCLUIDAS, A TÍTULO ENUNCIATIVO, LAS GARANTÍAS DE COMERCIABILIDAD Y DE APTITUD PARA UN FIN EN PARTICULAR. Al aceptar un Premio, cada ganador otorga su permiso al Patrocinador y a aquellos que actúan bajo su autoridad el derecho irrevocable, absoluto y que se puede otorgar en sublicencia, y permiso para usar su nombre, foto, apariencia, voz, información biográfica, declaraciones y cualquier otro indicio de imagen (independientemente de si está alterada, cambiada, modificada, editada, usada sola o usada junto a otro material a exclusivo criterio del Patrocinador), en cualquier momento, a perpetuidad, para fines de publicidad, comercio, avisos y promocionales sin compensación adicional (excepto donde está legalmente prohibido), en todos los medios conocidos en el presente o descubiertos en el futuro, en todo el mundo, en Internet y en la World Wide Web, sin notificación, revisión o aprobación. Los acompañantes en el viaje de los ganadores del Gran Premio deberán llenar, firmar y devolver una Exención de Responsabilidad y, donde sea legal, una autorización de publicidad, antes de la emisión de los documentos de viaje. Los participantes renuncian al derecho de reivindicar, como costo de ganar algún premio, cualquier y todos los costos de verificación y canje o viaje para reclamar dicho premio y cualquier responsabilidad y publicidad que pueda surgir de la reclamación o intento de reclamación de dicho Premio. En caso de surgir alguna discrepancia o incoherencia entre las divulgaciones u otras declaraciones contenidas en cualquiera de los materiales del Concurso para Redes Sociales y los términos y condiciones de estas Reglas Oficiales, prevalecerán, regirán y ejercerán el control estas Reglas Oficiales.

 

8. Lo anterior incluye, a título enunciativo, la falla del Patrocinador de recibir cualquier Participación y/o la falla del ganador potencial de recibir a tiempo el mensaje privado (directo) del Patrocinador debido a tecnologías de filtrado, u otras tecnologías de Twitter. Las Entidades del Concurso para Redes Sociales no son responsables por los errores de cualquier clase, ya sean humanos, mecánicos, electrónicos, de la red, tipográficos, de imprenta, u otro tipo, relacionados con el Concurso, incluidos, a título enunciativo, los errores que puedan ocurrir en relación con la administración del Concurso para Redes Sociales, el procesamiento de las Participaciones y/o el anuncio o contacto con los ganadores potenciales de los Premios. 9. VARIOS:

 

A. Descalificación: Es responsabilidad exclusiva del Participante asegurarse de que ha cumplido plenamente con todas las condiciones y requisitos que se establecen en estas Reglas Oficiales. Si se descubre que un posible ganador no es elegible o no ha cumplido con estas Reglas Oficiales o bien renuncia a un premio por cualquier motivo antes de su entrega, este posible ganador será descalificado y podrá elegirse a un ganador alternativo. El Patrocinador se reserva el derecho de solicitar indemnización por daños y presentar otros recursos contra dicha persona en la mayor medida permitida por la ley.

 

 B. Fuerza mayor. El Patrocinador se reserva el derecho, en cualquier momento y sin notificación previa, a dar por finalizado el Concurso para Redes Sociales, total o parcialmente, o a modificar, suspender o ampliar el Concurso para Redes Sociales de cualquier forma si determina, según su exclusivo criterio, que el Concurso para Redes Sociales está técnicamente afectado o viciado o establece que ciertos problemas técnicos, fraudes, fallas o desperfectos (lo que incluye, a título enunciativo, virus de computación u otros Concursos para Redes Sociales perjudiciales, errores en los materiales, desperfectos o errores de impresión o producción) han destruido o desvirtuado seriamente la integridad y/o viabilidad del Concurso para Redes Sociales. Si el Patrocinador se viera impedido de continuar con el Concurso para Redes Sociales, de acuerdo con lo que se contempla en este documento, por cualquier acontecimiento fuera de su control, incluidos, a título enunciativo, incendios, inundaciones, epidemias de salud naturales u ocasionadas por el hombre, terremotos, explosiones, conflictos laborales o huelgas, casos fortuitos o de enemigo público, fallas en los satélites o equipos, revueltas o disturbios civiles, amenazas o actividades terroristas, guerra (declarada o no declarada) o lo dispuesto por cualquier ley, orden o reglamentación gubernamental federal, estatal o local, crisis de la salud pública, lo dispuesto por un mandato de un tribunal o jurisdicción u otra causa que no esté razonablemente dentro del control del Patrocinador (cada uno de ellos denominado un acontecimiento o suceso de “Fuerza mayor”) y, por ende, sujeto a cualquier aprobación gubernamental que pueda ser necesaria, el Patrocinador tendrá derecho a modificar, suspender, ampliar o dar por finalizado el Concurso para Redes Sociales y otorgar los Premios en la manera que considere apropiada y justa. C. Invalidez: La invalidez o inaplicabilidad de cualquier disposición de las presentes Reglas Oficiales no afectará la validez ni la aplicabilidad de cualquier otra disposición. En caso de que se establezca que una disposición no tiene validez, o es de otro modo inaplicable o ilegal, las presentes Reglas Oficiales permanecerán vigentes y se interpretarán conforme a sus términos como si la disposición inválida o ilegal no estuviera incluida en el presente. D. Además, si el Participante puede demostrar que los costos del arbitraje serían prohibitivos en comparación con los costos del litigio, el Patrocinador pagará la suma correspondiente a los cargos de presentación y audiencia del Participante relacionados con el arbitraje que el árbitro considere necesarios para evitar que el arbitraje tenga un costo prohibitivo; y (9) excepto por lo dispuesto en el inciso (6) anterior, si alguna parte de esta cláusula de arbitraje fuera considerada no válida, inaplicable o ilegal o, de otro modo, entrara en conflicto con las Reglas y procedimientos dispuestos por la AAA, el resto de esta cláusula de arbitraje seguirá teniendo vigencia y será interpretada de acuerdo con sus términos como si la cláusula no válida, inaplicable, ilegal o conflictiva no hubiese sido incluida en el presente. If, however, subpart (6) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither Sponsor nor Participant shall be entitled to arbitrate their dispute.
